Terms of Sale
Ezra's Auctions · Version 2026-10-06.1
These terms apply to every purchase made through the Store, whether you pay the listed price or a price agreed through a private offer. By placing an order you accept the version of these terms shown at checkout; the version number is stored with your order.
1. What we sell and how
The Store sells its own pre-owned and surplus goods at fixed prices. You may buy an item at its listed price, or send a private offer that the Store may accept, counter or decline. Offers are private, one-to-one negotiations between you and the Store: no other buyer sees your offer, there is no closing time and no buyer's premium. Buyers never compete against each other for an item; the Store simply agrees a price with you or does not.
2. Sold as-is
Every item is sold as-is, as described and photographed, with no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Condition notes and photographs form part of the description. Read them before you buy. Items are used unless the listing says otherwise, and may show wear that is not individually called out.
3. All sales final; not-as-described claims
All sales are final. The single exception is an item that is materially not as described. If you believe that applies:
- Contact us within 7 days of delivery or pickup, with photographs.
- If the claim is approved, the Store issues a full refund to the original card. For shipped items the Store pays the return shipping and sends you a prepaid label.
- There is no restocking fee.
Buyer's remorse, incorrect size, or wear that was visible in the photographs or condition notes is not a not-as-described claim. See the Returns policy for details.
4. Prices, payment and title
Prices are in US dollars. Sales tax is calculated at checkout where the Store is required to collect it. Payment is by card through our payment processor; we never see or store your full card number. Title passes to you when payment succeeds. Risk of loss passes when you collect the item or when the carrier takes possession of it.
5. Accepted offers and your card on file
To send an offer you keep a card on file and agree to the Offer Terms. When the Store accepts your offer (or you accept the Store's counter), the item is held for you in your cart at the agreed price and you have 48 hours to complete checkout. The card on file is not charged automatically. If you have not paid by then, the agreement is cancelled, the item goes back on sale and the lapse is recorded against your account.
6. Local pickup
Local pickup is available Monday to Friday, 10:00 to 18:00 Eastern, at the address on the Shipping & Pickup page. Book a slot at checkout or from your order page; rescheduling is free up to two hours before the slot. Bring your order number and pickup code. For orders over $500 the person collecting must show photo ID matching the buyer's name.
If an order is not collected we send reminders after 3 and 6 days. We do not cancel unclaimed orders automatically and we do not charge a restocking fee; after 30 days we will contact you to arrange collection or an alternative.
7. Shipping and freight
Parcel shipping is offered at the rate quoted at checkout. Large items ship by freight: you request a quote, we send one that is valid for 7 days, and the order proceeds when you accept and pay it. Shipping is to addresses in the United States only.
8. Prohibited items
The Store does not list firearms, ammunition, weapons, alcohol, tobacco or vaping products, drugs, prescriptions or supplements, recalled goods, or hazardous materials. If a listed item is later found to fall in one of these classes the sale is cancelled and refunded in full.
9. Chargebacks
If you dispute a charge with your card issuer, the Store will provide the issuer with the listing, the photographs and condition notes, your acceptance of the version of these terms recorded on the order, and the delivery or pickup record. Please contact us first: most problems are quicker to fix directly.
10. Governing law and venue
These terms are governed by the laws of the State of Ohio. Any dispute is heard in the state or federal courts sitting in Summit County, Ohio, and you consent to that venue.
11. Changes
We may change these terms; the version in force when you order is the one that applies to that order. Contact details are in the footer of every page.
